What Is a Defective Product or Products Liability Case?

A products liability case asks whether a manufacturer, distributor, or seller placed a dangerous product into the marketplace and failed to protect the people who used it. In general, these cases fall into three broad categories.

Design defects involve products that are unreasonably dangerous in the way they were designed. Even when built correctly, they carry risks that could have been reduced or avoided with a safer design. Manufacturing defects arise when something goes wrong in the production process so that a particular batch or unit does not match the intended design. Failure to warn claims focus on whether a company knew or should have known about serious risks but failed to give patients and consumers clear, understandable warnings.

 

In practical terms, defective product cases often involve medical devices that break or migrate inside the body, drugs linked to unexpected cancers or organ damage, or consumer products that expose users to toxic chemicals. My role is to examine the product, your medical history, and the scientific evidence to determine whether a defect in the product likely contributed to your injuries.

Depo Provera

 

Depo Provera is an injectable hormonal contraceptive given every three months. In addition to long standing concerns about bone density and blood clots, emerging litigation focuses on an association between long term Depo Provera use and intracranial meningiomas, which are tumors that can compress brain tissue and require major surgery. Evaluating these cases involves reviewing prescription history, the timing of tumor diagnosis, and understanding the best available scientific evidence.

Dupixent

 

Dupixent is a biologic medication used for conditions like moderate to severe eczema and asthma. While it can be life changing for some patients, lawsuits and safety concerns focus on severe eye problems and certain systemic immune reactions that developed after treatment. Patients report persistent conjunctivitis, keratitis, vision changes, and eosinophilic conditions. When I review a potential Dupixent case, I look closely at the course of treatment, the onset of new symptoms, and the warnings provided to the patient.

Paragard IUD

 

Paragard is a hormone free copper intrauterine device that many women chose as a long term birth control option. Lawsuits allege that Paragard IUDs can fracture during removal or while still in place, leaving pieces embedded in the uterus or migrating into the abdomen or pelvis. Women report uterine perforations, infections, the need for emergency surgery, and in some cases, loss of fertility. I investigate whether device breakage and resulting surgeries were avoidable and tied to a dangerous design.

Paraquat Herbicide

 

Paraquat is a restricted use herbicide applied to crops across the country. Current litigation focuses on whether long term occupational or environmental exposure is associated with Parkinsons disease and related neurological problems. These cases often involve farm workers, applicators, and rural residents with many years of potential exposure. I review work histories, exposure pathways, and medical records to evaluate whether a Paraquat claim may be viable under the evolving science and legal rulings.

Talcum Powder

 

For decades, talc based powders were marketed for use on babies and as part of daily feminine hygiene routines. Lawsuits now allege that long term genital use of talc products is associated with an increased risk of ovarian cancer and that some talc products were contaminated with asbestos. Talc cases require a careful look at product use over many years, the type of cancer involved, and how the emerging science applies to a particular diagnosis.

Chemical Hair Relaxers

 

Chemical hair relaxers and straightening kits have been heavily marketed to Black women and girls. Recent studies suggest that frequent, long term use of certain relaxers may be associated with higher rates of uterine, ovarian, and breast cancer, as well as serious fibroid disease. Litigation claims that manufacturers used endocrine disrupting chemicals without adequate testing or warnings. Bard PowerPort and Other Implantable Ports

 

Implantable port catheters are supposed to provide safe, reliable access for chemotherapy and other intravenous treatments. Certain Bard PowerPort models are alleged to be prone to cracking, fracturing, and migrating inside the body, leading to blood clots, heart and lung injuries, infections, and emergency surgeries to retrieve broken pieces. These cases involve detailed review of device model numbers, implantation records, imaging, and expert analysis of how the port failed.
